Last update January 15, 2025
This policy, set forth by PROXIED LIMITED ("Company"), a company incorporated in HONG KONG with its registered address at UNIT B, 11/F YAM TZE COMM BLDG 23 THOMSON RD WAN CHAI, HONG KONG, establishes the terms and conditions for refunds that may be claimed in the context of a contractual relationship between the Company, as the service provider, and a natural person or entity("User"), as the recipient of the services.
1. No Refund Policy
All fees paid by the User are non-cancellable and non-refundable in principle. This also applies to payments made for a continuous or ongoing service.
2. Exceptions to the No-Refund Policy
2.1 A claim for a refund shall exist exclusively if the contractually agreed-upon service is rendered unusable or can only be used with significant limitations within the first 24 hours after its purchase, for reasons that are not the responsibility of the User.
2.2 The assertion of a refund claim requires the User to promptly provide the Company with the opportunity to remedy the defect. If the Company is not granted this right to cure the defect, the right to a refund shall lapse.
2.3 The obligation to remedy the defect and the resulting obligation to provide a refund relate exclusively to the services contractually owed by the Company. An obligation to cure or provide a refund is excluded if the functionality of the Company’s service is impaired due to its incompatibility with third-party software. This does not include third-party software that is specified as compatible in a service description on the sales page for each product.
2.4 If the Company remedies the defect within 24 hours after being promptly notified by the User and having been given the opportunity to cure, any claim for a refundbased on that defect is excluded.
3. Exclusion of Refund
A claim for a refund is also excluded if the User has used the Company's services for unlawful purposes.
4. Equitable Provisions
The Company reserves the right, in exceptional cases, to refund a reasonable amount if the totality of the circumstances makes a refund appear fair and necessary. Any such concession does not bind the Company for future decisions.
